Acceptance of Terms

By using Nexio App, you agree to comply with and be bound by these Terms of Service.
If you do not agree with any part of these terms, please do not use the platform.

These terms form a legally binding agreement between you and Nexio App (“we,” “us,” or “our”).
We may modify these terms at any time. Continued use of the platform after updates constitutes your acceptance of the revised terms.

Service Description

Nexio App is a community contribution and collaboration platform that enables users to:

Submit, manage, and review community contributions
Collaborate on shared projects or workspaces
Access different features based on your subscription plan
Receive notifications, updates, and platform insights

We aim for high uptime and performance but do not guarantee uninterrupted access.
Scheduled maintenance or unforeseen technical issues may occasionally affect availability.

User Responsibilities

Account Requirements

You must be at least 16 years old to use Nexio App.
You must provide accurate and complete registration details.
You are responsible for maintaining the confidentiality of your login credentials.
Notify us immediately of any unauthorized access or security breach.

Acceptable Use

You agree to:

Use the platform only for lawful purposes
Respect the rights and intellectual property of others
Refrain from uploading or sharing illegal, offensive, or harmful content
Follow all community guidelines and contribution rules

Accuracy of Information

You are solely responsible for the accuracy of the content and information you upload, including contributions, project data, and payment details.

Privacy & Data

Your privacy is governed by our Privacy Policy.
By using Nexio App, you consent to the collection and processing of your data in accordance with that policy.

Data Ownership

You retain ownership of all content and contributions you create or upload to Nexio App.
By submitting content, you grant us a limited, non-exclusive, and revocable license to store, process, and display that content as needed to operate the service.

Third-Party Services

Some features (e.g., integrations, analytics, or payments) may rely on third-party providers.
By connecting such services, you authorize Nexio App to exchange data strictly within the permissions you grant.

Data Backup

We maintain regular data backups, but we recommend keeping local copies of critical information.
We are not responsible for loss of data due to external failures or user error.

Prohibited Uses

You may not use Nexio App to:

Illegal or Abusive Activity

Engage in unlawful, fraudulent, or deceptive behavior
Impersonate others or misrepresent your identity
Post, share, or distribute content that is harmful, abusive, or discriminatory

Technical Abuse

Attempt to access systems without authorization
Disrupt or overload our servers
Reverse-engineer, copy, or modify the platform’s software
Use automated bots or scripts to interact with Nexio App

Spam or Commercial Misuse

Send spam, advertisements, or unsolicited messages
Resell or redistribute Nexio App without written permission
Use Nexio App to compete directly with our business
Mine or harvest user data for commercial gain

Violations may result in immediate account suspension or termination without notice.

Payment & Billing

Free and Paid Plans

Nexio App offers both free and paid subscription tiers with different features and usage limits.

Free plans provide limited functionality.
Paid plans unlock advanced features, collaboration tools, and additional storage.
Pricing and available features may change with prior notice.
Payments are handled securely by third-party processors.

Cancellations and Refunds

You may cancel your subscription at any time via your account settings.
Cancellation takes effect at the end of your current billing cycle.
We do not issue partial refunds for unused time or downgraded accounts.
Inactive paid accounts may lose premium access immediately upon downgrade.

Liability & Disclaimers

Service Disclaimer

Nexio App is provided “as is” and “as available.”
We make no warranties regarding:

Uninterrupted or error-free operation
Compatibility with all devices or browsers
Accuracy or reliability of data or content

Limitation of Liability

To the fullest extent permitted by law, Nexio App shall not be liable for:

Indirect, incidental, or consequential damages
Loss of data, revenue, or business opportunities
Service interruptions, bugs, or third-party actions

Our total liability shall not exceed the amount you paid for the service in the 12 months prior to the claim, or €100, whichever is higher.

Termination

By You

You may close your account at any time through your account dashboard.
Upon termination, your access to Nexio App will be revoked, and all personal data will be deleted within 30 days unless required by law.

By Nexio App

We may suspend or terminate your account if you:

Violate these Terms of Service
Engage in fraud or illegal activity
Fail to pay subscription fees
Abuse our platform, community, or support staff

After termination, your data will be deleted or anonymized within 90 days, except where legally required to retain it.

Governing Law & Dispute Resolution

These Terms of Service are governed by EU and Dutch law.
Any disputes shall be resolved through binding arbitration or, where applicable, the courts of the Netherlands.

You waive the right to participate in class-action lawsuits.
We always aim to resolve issues amicably before formal proceedings.

Changes to These Terms

We may update these Terms of Service from time to time.
When we do, we will:

Update the “Last updated” date at the top of this page
Notify you via email or in-app message if significant changes occur
Allow you to review and accept or reject changes

Continued use of Nexio App after updates means you accept the revised terms.
